Vehicle & Movable Property Transaction Legal Tracking & Service Agreement

2. Subject of Agreement
The subject of this Agreement is the determination of procedures and conditions regarding the professional tracking of vehicle or other movable property purchase, sale, transfer, or delivery processes, upon the request of the Service Recipient, by an attorney including legal examination, document control, contract preparation, payment and delivery security, official transfer coordination, and other relevant transaction steps.
3. Scope of Service
The Service Provider may perform all or part of the following services according to the nature of the specific file:
• Examine documents and records relating to the vehicle or movable property
• Conduct legal assessment regarding owner, authority, and transfer eligibility
• Prepare or revise sale agreements, deposit agreements, delivery reports, commitments, and similar texts
• Establish legal structure for payment and delivery security
• Support coordination of notary and official transfer processes
• Inform the party about transaction risks
• Provide written legal assessment when necessary
4. No Result Guarantee
The Service Provider offers legal support within the framework of professional care. However, it shall not be deemed guaranteed that:
• The transaction will definitely be completed
• The transfer will certainly take place
• No issues will arise regarding the movable property later
• There are absolutely no technical defects
5. Service Fee
The Parties agree that in return for attorney-assisted vehicle and movable property transaction tracking services, the Service Recipient shall pay a service fee of 2% of the sale price to the Service Provider.
This fee is calculated based on the actual sale price accepted by the parties, the price written in the contract, payment documents, or other evidence showing the transaction price.
Minimum service fee: €500.
Examples:
• Vehicle price €8,000 → Service fee: €500 (minimum applies)
• Vehicle price €30,000 → Service fee: €600
• Vehicle price €50,000 → Service fee: €1,000
6. Payment Schedule
Unless otherwise agreed in writing:
• 50% of the service fee is due at commencement of work
• Remaining 50% becomes due upon signing of the sale agreement, completion of the official transfer, or completion of the delivery process
7. Minimum Service Fee
The Parties may separately agree that, regardless of the sale price, the service fee shall not fall below €500 under any circumstances.
This is commercially important because 2% of low-value transactions may be insufficient to cover professional effort.
8. Expenses Not Included
Unless explicitly agreed otherwise in writing, the following items are NOT included in the service fee:
• Notary fees
• License / registration fees
• Plate fees
• Traffic / registration charges
• Insurance costs
• Expert appraisal fees
• Bank charges
• Translation & certification costs
• Taxes & official duties
• Third-party technical service costs
These expenses shall be covered separately by the requesting party.
9. Service Recipient's Obligations
The Service Recipient is obligated to:
• Provide accurate and complete information
• Submit required documents in a timely manner
• Make truthful declarations regarding seller, owner, proxy, or other transaction parties
• Pay fees and expenses on time
The Service Provider shall not be responsible for consequences arising from incomplete or incorrect information.
10. Technical Inspection Distinction
Legal tracking service does not substitute for technical expertise. For vehicles and other movable property, a separate technical inspection is recommended for risks related to:
• Mechanical and electronic condition
• Body / frame damage
• Mileage verification
• Engine / chassis authenticity
• Depreciation assessment
• Usage performance
11. Early Termination & Fee Rights
If the Service Recipient abandons the process, agrees directly with the counterparty, bypasses the attorney, or unilaterally stops the transaction, the accrued fee right for legal effort and file work provided up to that date is reserved.
12. Applicable Law & Jurisdiction
The law of the Republic of Kosovo shall apply to this Agreement. In case of disputes, the competent courts and enforcement offices of Prishtinë / Priština shall have jurisdiction.
